Subject: JAF Group meeting (1) held in Brussels on 12-13 October 2005

1. Adoption of the agenda

The Group adopted the provisional agenda as set out in Annex 2.

2. Approval of Summary of conclusions of the previous meeting

The Group approved the Summary of Conclusions of the JAF meeting of 19-20 May 2005 as set out in doc. COST 6/05.

3. Voting procedures in the CSO

The Group examined the proposal for voting procedures in the CSO as set out in the document COST 262/03/05 REV 3 and agreed to submit a slightly amended version to the next CSO meeting for approval.

4. Legal personality of COST

The President presented a paper as basis for discussion concerning the background to raise this issue and the different options for a legal personality of COST.

The representative of the Council Legal Service recalled that any Council decision on participation by the Community in a legal entity or creation of a body under Community law would require a proposal by the Commission following the provisions of the Treaty.

The Group generally agreed that considering the well functioning cooperation with the ESF as the implementing agent for COST, as set out in the Memorandum between COST and the ESF (doc. COST 262/02), there was no urgent need for seeking a legal personality for COST.

However, it was also recognised that in anticipation of any changes to the present situation in the longer term the question could be further examined, also taking into account the substantial work already undertaken by the CSO and its previous Chair in 2002 (1), when examining the possibility to create an AISBL under Belgian law.

The JAF concluded that the item would be subject to further examination at a later stage.
