REPORT from: COREPER dated: 11 October 2005 to: COUNCIL No. Cion prop.: 11834/05 Subject: Proposal for a Council Decision concerning the provisional prohibition in Greece of the marketing of seeds of maize hybrids with the genetic modification MON 810 inscribed in the common catalogue of varieties of agricultural plant species, pursuant to Directive 2002/53/EC COMMON GUIDELINES Consultation deadline: 21.10.05

1. The aim of the above proposal is to deny authorisation to Greece to ban the marketing of seeds of maize hybrids with the genetic modification MON 810 included in the common catalogue of varieties of agricultural plant species.

2. When this question was referred to it in July 2005, the Standing Committee on Seeds and Plant Propagating Material was unable to deliver an opinion.

Eleven Member States (162 votes) voted in favour of withdrawal of the ban, nine Member States (109 votes) voted against, and four (47 votes) abstained.

3. On 30 August 2005 the Commission therefore submitted the planned measure to the Council, which has three months from that date in which to act by a qualified majority.

4. At its meeting on 10 October 2005, COREPER made a list of delegations' voting intentions on this proposal and agreed to submit the list to the Council in the form of a table (see Annex).
