An action against the Austrian government by University of Innsbruck history of law professor Gerhard Kobler has established a new legal right for all European Union citizens to sue their national supreme court for damages if its rulings break EU law. The Austrian courts wrongly rejected Professor Kobler's request for a special length-of-service salary increment because some of his academic career had been spent in Germany.
