Brussels, 12 Sep 2006
No. Cion prop.: 11640/06
Subject: Proposal for a Council Decision concerning the placing on the market, in accordance with Directive 2001/18/EC of the European Parliament and of the Council, of oilseed rape products (Brassica napus L., lines Ms8, Rf3 and Ms8xRf3) genetically modified for tolerance to the herbicide glufosinate- ammonium.
1. The aim of this proposal is to authorise the placing on the market of the above-mentioned oilseed rape products. The authorisation would apply to all uses with the exception of cultivation and uses in food and would be valid for 10 years.
2. On 5 December 2005, the Commission consulted the Regulatory Committee on the deliberate release into the environment of GMOs which, despite the favourable opinion delivered by the Food Safety Authority, was unable to give an opinion.
3. On 11 July 2006, the Commission accordingly submitted its proposal to the Council, which has a 3-month period from that date within which to act by qualified majority.
At its meeting on 8 September 2006, COREPER checked whether Member States' positions have changed sufficiently to allow the Council to reach a decision on this proposal.1
The voting intentions indicated by the delegations - which do not substantially differ from the votes in the Regulatory Committee meeting - are set out in table form in the Annex.
4. In conclusion the Committee agreed to invite the Agriculture/Fisheries Council to confirm the positions of delegations at its session on 18 September 2006.
Votes of the Member States in the Regulatory Committee
1 DK maintained at this stage a parliamentary scrutiny reservation.
