No Cion prop. 13042/05

Subject: Adoption of a Council Decision authorising the placing on the market of food containing, consisting of, or produced from genetically modified maize line 1507 (DAS-Ø15Ø7-1) under Regulation (EC) No 1829/2003 of the European Parliament and of the Council
COMMON GUIDELINES
Consultation deadline for Bulgaria and Romania: 15.12.2005

1. The purpose of the above proposal is to authorise the placing on the market of food and food ingredients containing genetically modified maize line 1507.

The proposal is based on Regulation (EC) No 1829/2003 on genetically modified food and feed, and applies, inter alia, the specific requirements of the latter with regard to labelling, monitoring for environmental effects, and entry in the Community register. It also provides for notification of the Decision to the Parties to the Cartagena Protocol pursuant to Regulation (EC) No 1946/2003 .

2. On 3 March 2005 the European Food Safety Authority gave its opinion that there was no evidence to indicate that the placing on the market of these food products was likely to cause adverse effects on human or animal health or on the environment.

On 3 June 2005 a draft Commission Decision authorising the food products in question was put to the vote in the Standing Committee on the Food Chain and Animal Health, which was unable to deliver an opinion, however.

On 6 October 2005 the Commission accordingly submitted its proposal to the Council, which has a period of three months from that date in which to act by a qualified majority.

3. At its meeting on 7 December 2005 Coreper checked the delegations' voting intentions regarding this proposal and agreed to submit them to the Council in the form of the table annexed hereto.

ANNEX: Member States' indicative votes

For - 11 delegations, 159 votes

Against - 10 delegations, 90 votes

Abstention - 4 delegations, 72 votes
