Manquement d'État - Protection juridique des inventions biotechnologiques

Advocate General Ruiz-Jarabo Colomer concluded:

je propose à la Cour de déclarer que la République italienne a manqué aux obligations contenues aux articles 6, paragraphe 2, et 8 à 12 de la directive 98/44/CE du Parlement européen et du Conseil, du 6 juillet 1998, relative à la protection juridique des inventions biotechnologiques, de rejeter le recours pour le surplus et de condamner expressément l'État défendeur à payer ses propres dépens et la moitié de ceux engagés par la Commission.
