COMMON GUIDELINES

1. On 26 November 2003, the Commission submitted to the Council its proposal for a Decision of the Council and the Commission on the signature on behalf of the European Community and of the European Atomic Energy Community of the Agreement on Scientific and Technological Cooperation between the European Communities and the Swiss Confederation.

2. The Agreement has been negotiated on the basis of negotiating directives adopted by the Council on 20 February 2003 and it was initialled on 5 September 2003.

3. This agreement is based on the principles laid down in its predecessor, in particular with regard to the contribution from the Swiss Confederation to the budgets for the Sixth (EC and Euratom) Framework Programmes.

4. Because of horizontal policy considerations, discussion on the agreement took place in the EFTA Working Party where it was concluded that this agreement should be signed.

5. Following consultations with the Joint Research/Atomic Questions Working Party, it is suggested that the Permanent Representatives Committee recommend that the Council adopt, as an "A" item, the Decision approving the signing1 of this Agreement. The text of this Decision and the Agreement, following finalisation by the legal linguists, is set out in document 15753/03 RECH 251 ATO 221 AELE OC 836.

1 It is recalled that, following the signature of this Agreement, its conclusion will be subject to a subsequent Council decision after consultation of the European Parliament.
