Manquement d'Etat - Directive 98/44/CE - Protection juridique des inventions biotechnologiques - Non-transposition dans le delai prescrit

The Court ruled:

1) En n'ayant pas adopte, dans le delai prescrit, les dispositions legislatives, reglementaires et administratives necessaires pour se conformer a la directive 98/44/CE du Parlement europeen et du Conseil, du 6 juillet 1998, relative a la protection juridique des inventions biotechnologiques, la Republique federale d'Allemagne a manque aux obligations qui lui incombent en vertu de cette directive.

2) La Republique federale d'Allemagne est condamnee aux depens.
