COMMON GUIDELINES

1. The proposal for the above Directive, based on Article 63 of the EC Treaty, was submitted by the Commission to the Council on 30 March 2004.
2. The purpose of this Directive is to define a common specific procedure for admitting third- country nationals for the specific purpose of conducting scientific research in the territory of the Member States of the EU. To this end, it defines the third-country nationals to whom this procedure may apply and the conditions to which their admission is submitted. Moreover, it defines the statute that the third-country nationals admitted may enjoy and also provides, under the conditions that it sets, the possibility of exercising mobility.
3. This proposal has been extensively examined by the relevant Council bodies, both at technical and political level.
4. The European Parliament has delivered its opinion on the proposal on 12 April 2005.1
5. The Economical and Social Committee and the Committee of Region have delivered their opinions respectively on 17 October 20042 and 17 November 20043.

1. On 17 March 2004 the Commission submitted the above proposal 1, based on Article 62(2)(b)(ii) TEC, to the Council.
2. The Economic and Social Committee gave its Opinion on October 2004 2 and the Committee of the Regions gave its Opinion on 17 November 2004 3.
3. The original procedure for adopting this Recommendation, namely consultation of the European Parliament, was replaced as from 1 May 2004 by the co-decision procedure referred to in Article 251 TEC.

COMMON GUIDELINES

1. The proposal for the above Recommendation, based on Article 63 of the EC Treaty, was submitted by the Commission to the Council on 30 March 2004.
2. The purpose of this Recommendation is to facilitate the admission of third-country nationals to carry out scientific research. This recommendation identifies a series of areas in which action should be taken, in order to attract researchers from third-countries to the EU and to facilitate their entry and residence in the territory of its Member States.

4. The European Parliament has delivered its opinion on the proposal on 12 April 2004.1
