The proposed amendments to China's patent law include two new provisions that would impose additional disclosure obligations for genetic resource inventions. These provisions would increase uncertainty for inventors and would most likely result in reduced investment in China's biotechnology sector. Members of the American BioIndustry Alliance (ABIA) have serious reservations about the advisability of including these provisions in the upcoming patent amendments. This paper provides the ABIA's comments on the proposed provisions.
