Manquement d'Etat - Directive 2001/18/CE - Dissemination volontaire d'organismes genetiquement modifies dans l'environnement - Non-transposition dans le delai prescrit

The Court ruled:

1) En ne prenant pas les dispositions legislatives, reglementaires et administratives necessaires pour se conformer a la directive 2001/18/CE du Parlement europeen et du Conseil, du 12 mars 2001, relative a la dissemination volontaire d'organismes genetiquement modifies dans l'environnement et abrogeant la directive 90/220/CEE du Conseil, la republique d'Autriche a manque aux obligations qui lui incombent en vertu de cette directive.

2) La republique d'Autriche est condamnee aux depens.
