In these Service Specific Additional Terms, the following terms have the following meanings:

"Data"all information supplied by the User to THE (whether raw or processed), whether under a contract or otherwise, and whether transmitted in hard copy, electronic, online, disk or other form of media.
"Data Collection Portal"the portal provided by THE to the User to enable Users to submit the data in relation to the ranking and/or rating.
"Modern Slavery"slavery, servitude, forced or compulsory labour, and human trafficking as defined under the Modern Slavery Laws.
"Modern Slavery Laws"the Modern Slavery Act 2015 (UK) and any other applicable laws, statutes, regulations, and codes from time to time in force relating to slavery, servitude, forced or compulsory labour, and human trafficking, including (where applicable) any equivalent legislation in any relevant jurisdiction.
"Times Higher Education" or "THE"THE World Universities Insights Limited and its subsidiaries.
"User"any individual or legal entity that accesses, registers for, or uses the Data Collection Portal, whether on their own behalf or on behalf of an organisation, for the purpose of submitting, uploading, viewing, downloading, or otherwise interacting with data or content made available through the Data Collection Portal.

2.1 These Service Specific Additional Terms detail the additional terms and conditions which apply to your use of the Times Higher Education platform, website and related services and should be read in conjunction with our General Terms and Conditions ("General Terms"), our Website Terms of Use and our Privacy Policy.

2.2 These Service Specific Additional Terms, the General Terms, Website Terms of Use and Privacy Policy represent the entire agreement between us and you. In the event of a conflict between the General Terms, Website Terms of Use and these Service Specific Additional Terms, the terms of the Service Specific Additional Terms shall prevail.

3. User Submitted Data ("Data")

3.1 When uploading and submitting your Data to the THE Data Collection Portal (secure.timeshighereducation.co.uk/wur/portal) the normal terms regarding user uploaded content do not apply.

3.2 You grant THE a royalty-free, perpetual, irrevocable, non-exclusive and fully sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such data (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. With respect to all Data you post to the Website, you hereby waive any moral rights you have in the Data. You agree to perform all further acts necessary to perfect any of the above rights granted by you to THE, including the execution of deeds and documents, at our request.

3.3 You represent and warrant that you own or otherwise control all of the rights to the Data and can grant the rights set out above. You also represent, warrant and undertake that:

(a) the Data is accurate to the best of your knowledge and belief; and

(b) use of the Data will not infringe the rights of any third parties (including that the Data is not defamatory); and

(c) you have obtained all rights and consents that are necessary for you to provide the Data; and

(d) you will immediately notify us of any Data that does not comply with these Service Specific Additional Terms or may infringe the rights of, or cause damage to third parties.

4. Modern Slavery

4.1 The User represents, warrants, and undertakes that:

(a) neither the User nor any of its officers, employees, agents, subcontractors, or other persons associated with it has been convicted of any offence involving Modern Slavery, nor (to the best of its knowledge) has been or is the subject of any investigation, inquiry, or enforcement proceedings by any governmental, administrative, or regulatory body regarding any offence or alleged offence of or in connection with Modern Slavery;

(b) it conducts its business in a manner that is consistent with the requirements of the Modern Slavery Laws applicable to it;

(c) it has and shall maintain in place throughout the term of its use of the Data Collection Portal its own policies and procedures to ensure compliance with the Modern Slavery Laws, and will enforce them where appropriate;

(d) any data, information, or content submitted via the Data Collection Portal has not been obtained, produced, or compiled through the use of Modern Slavery, and does not relate to or facilitate any activity that would constitute a breach of the Modern Slavery Laws; and

(e) where the User is required by law to publish a modern slavery and human trafficking statement, it has done so and such statement is compliant with applicable Modern Slavery Laws.

4.2 Any breach of this clause shall be deemed a material breach of these Terms. Without prejudice to any other rights or remedies, THE may suspend or terminate the User's access to the Data Collection Portal with immediate effect upon written notice, and may report any suspected offence to the relevant authorities.

5. Liability and Warranties

5.1 Subject to Clause 9.1 of the General Terms, THE shall not be liable in contract, tort (including negligence), breach of statutory duty or otherwise for:

(a) all claims brought by a third party against THE or its affiliates in respect of infringement of that third party's intellectual property rights or arising out of or in connection with a breach of any of these warranties.

6. Termination

6.1 Without prejudice to our powers under the General Terms, you agree that we at our sole discretion, without notice to you, may:

(a) terminate or amend the General Terms or these Service Specific Additional Terms and/or any user's account; and/or

(b) preclude any user's access to the THE website(s) (or any part thereof), and seek any other lawful remedy available.
