Subject: Proposal for a Council Decision authorising the placing on the market of foods and food ingredients derived from genetically modified maize line MON 863 as novel foods or novel food ingredients under Regulation (EC) No 258/97 of the European Parliament and of the Council

1. The purpose of the above proposal is to authorise the placing on the market of foods and food ingredients produced from genetically modified maize line MON 863.

2. The request for authorisation, which was submitted before the entry into force of Regulation (EC) No 1829/2003 on genetically modified food and feed, was processed in accordance with Regulation (EC) No 258/97 concerning novel foods.

On 19 May 2005, despite a positive opinion from the European Food Safety Authority on this transgenic maize, and validation of the detection method by the Joint Research Centre, the Standing Committee on the Food Chain and Animal Health was not able to deliver an opinion on the request1.

3. On July 2005 the Commission therefore submitted the planned measure to the Council, which has three months from that date in which to act by a qualified majority.
