Working Party on Atomic Questions 14 December 2005

Subject: - A new framework for Euratom safeguards
- Instrument for Nuclear Assistance
- 2nd WPNS interim report

1. A new framework for Euratom safeguards

The Working Party reached agreement on the document on "A New Framework for Euratom Safeguards" as revised and set out in doc. 15802/05 , with a view to Coreper/Council (under "I/A" items, doc. 15795/05 ).

2. Instrument for Nuclear Assistance

The Working Party continued the examination of the draft Council Regulation establishing an Instrument for Nuclear Assistance (doc. 15171/1/05 ) and reached a broad agreement on its scope (Title I) subject to, notably, the request of certain delegations to scrutinise further the inclusion of the reference to nuclear safeguards in the Regulation.

It was recalled that the more horizontal implementation aspects will continue to be examined in the context of the envisaged Instrument for Stability (doc. 9678/2/05 ) which is also intended to cover the topics of the security of energy infrastructures as well as the export controls on dual-use goods, which would therefore not need to be repeated under the Instrument for Nuclear Assistance.

The Commission representative welcomed the progress made by the Working Party whilst recalling his Institution's hesitations concerning some elements of the draft text (notably the title, recital 11a, Art. 6 and Art. 22.2).

The Presidency undertook to revise the text as the basis for further examination.

3. 2nd WPNS interim report

The Working Party took note of the second interim report by the Working Party on Nuclear Safety (WPNS) as finalised and as set out in doc. 15458/1/05 + COR1, compiled from information provided under the responsibility of the WPNS sub-groups.

4. Other business

­ The Working Party noted that, following an adjustment of the "Objectives" section of the draft mandate for the Commission to negotiate a limited renewal of Euratom's participation to KEDO, the draft negotiating directives as amended could be submitted, as envisaged, for adoption by the Council as set out in doc. 15523/05 RESTREINT UE + COR 1 + COR 2.

­ Upon request, the Commission representative informed the Working Party that, following the consultation of the Economic and Social Committee, the Commission envisages adopting, by 21 December, its definitive proposal for the Directive on the supervision and control of shipments of radioactive waste and spent fuel.
